Terms of Service
Last updated: March 19, 2026. These terms govern the business use of the Complert.io platform and related services.
1. Scope of Service
Complert.io ("Service") is a software-as-a-service (SaaS) platform that provides tools for training and course management, certification workflows, inspection processes, asset tracking, and operational documentation.
Complert.io provides technical infrastructure only and does not act as a certification authority, inspection body, or regulatory entity.
2. Contracting Party
These Terms apply to all business customers ("Customer") using the Service. The Service is offered exclusively to entrepreneurs (Unternehmer) within the meaning of section 14 BGB. Use by consumers is excluded.
3. Account and Access
The Customer is responsible for:
- maintaining accurate account information
- managing user roles and permissions
- all activities performed under its account
Users such as trainers, inspectors, or employees act on behalf of the Customer. The Customer remains fully responsible for user actions.
4. Customer Responsibilities
The Customer is solely responsible for:
- the accuracy and completeness of data entered into the Service
- compliance with applicable laws and regulations
- proper execution of training, inspections, and certifications
- the legality and correctness of generated documents
5. Certification and Inspection Disclaimer
Complert.io enables generation of certificates, inspection records, and related documents based on Customer input.
Complert.io does not:
- verify data correctness
- validate training or inspection processes
- guarantee legal validity of certificates
- act as an accredited certification body
6. Data Processing and Ownership
All data entered into the Service remains the Customer's property. Complert.io processes data only to provide the Service.
- Customer = Controller
- Complert.io = Processor
Details are governed by the Data Processing Agreement (DPA) and the Privacy Policy.
7. Subscription, Billing, and Plans
- Billing is recurring (monthly or annual depending on plan)
- Subscriptions renew automatically unless cancelled
- Fees are due in advance
Complert.io may modify pricing with reasonable notice and may suspend access in case of non-payment.
8. Availability and Maintenance
Complert.io targets high availability but does not guarantee uninterrupted access. Temporary interruptions may occur due to maintenance, updates, or technical issues.
9. Acceptable Use
The Customer may not use the Service for:
- unlawful activity
- fraudulent or misleading certifications
- impersonation or falsification of records
- misuse of verification features
10. Public Verification Portal
Verification confirms only that a document exists in the system and that visible data matches stored records. It does not confirm training authenticity, qualifications, or regulatory compliance.
11. Notifications and Automation
Automated notifications are provided as a convenience. Complert.io does not guarantee delivery, timeliness, or correctness of reminders.
12. Limitation of Liability
Complert.io is liable without limitation for intent, gross negligence, and injury to life, body, or health. For ordinary negligence, liability is limited to fees paid by the Customer in the twelve months before the claim event.
Complert.io is not liable for loss of profits, indirect damages, data loss caused by Customer actions, compliance failures of the Customer, or misuse of the Service.
13. Term and Termination
The contract runs for the selected subscription period. The Customer may cancel effective at the end of the current billing period. Complert.io may suspend or terminate in cases of breach or non-payment.
14. Changes to the Service
Complert.io may modify the Service, including adding or removing features, improving functionality, and adjusting technical requirements. Significant changes are communicated in advance where reasonable.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction is the registered office of the provider, where legally permitted. The CISG does not apply.
16. Final Provisions
If a provision of these Terms is invalid, the remaining provisions remain effective. No oral agreements exist.
